WINTER SWEEPSTAKES RULES
Montana Winter Vacation Sweepstakes ("Sweepstakes") is offered and open only to legal residents of the United States and District of Columbia who are 18 years or older. Employees, officers and directors of the Montana Department of Commerce (sponsor), and their affiliates, prize suppliers, advertising and promotion agency, and the immediate family members (defined as current spouse as well as siblings, children and parents and their respective spouses; regardless of where they live) or members of the same households (whether related or not) of such employees/officers/directors are not eligible. Void where prohibited by law.
1. TO ENTER: (A) STORE ENTRY. Between December 6-7, 2008 go to the Seattle, Washington REI store and obtain an official entry form. Complete entry form with your printed name, address, daytime telephone number, and e-mail address (if any). Deposit completed entry form in the specially marked entry box for receipt by close of business on December 7, 2008 in Seattle, Washington. If supplies of entry forms are exhausted, you may instead enter by printing the above-indicated entry information on a 3" x 5" card/paper and depositing same in the entry box. No mechanical reproductions of entries will be accepted.
(B) ON-LINE ENTRY. Between November 2, 2007 at 12:01 a.m. Mountain Time ("MT") and 11:59 p.m. MT on December 31, 2008, go to www.wintermt.com/REI to register to win. On the Sweepstakes Page, complete and submit an on-line official entry form, with your name, address, daytime telephone number, and e-mail address. All on-line entries must be received by 11:59 p.m. MT on December 31, 2008. No other form of Internet/email entry will be accepted. Limit one entry of any kind per person or e-mail address. Any person who attempts to participate with multiple email and/or street addresses, under multiple identities or uses any device or artifice to enter multiple times will be disqualified. In case of dispute, on-line entry will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No responsibility is assumed by Sponsor for lost, late, damaged, incomplete, stolen, misdirected, illegible entries/e-mail; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions/failures; or for garbled, jumbled or corrupt transmissions; or for other technical error of any kind. Once submitted, entries become sole property of Sponsor and will not be returned.
2. WINNER SELECTION: Winners will be selected in a random drawing from among all eligible entries received. The drawing will be conducted by the Montana Department of Commerce the week of January 5, 2009. By participating, entrant agrees to these Official Rules and the decisions of the Sponsor, which are final and binding in all respects. Winners will be notified by e-mail, phone or mail (at Sponsor's sole discretion) approximately 10 days after the drawing. No substitution or transfer of prize is permitted, but Sponsor reserves the right, at its sole discretion, to substitute advertised prize with another prize of equal value should advertised prize become unavailable for any reason. Limit one prize per family/address/household.
3. PRIZES/ODDS: Grand Prize (1) - an all-expense paid winter trip to either Bozeman, Montana or Whitefish, Montana for 5 days/4 nights for the winner and one guest. Trip consists of round-trip coach air travel for two, accommodations to be provided for winner and his/her guest, ground transportation, lift tickets, two additional activities for two offered by sponsor and chosen by winner, and food for two people. Approximate retail value: $4,999.
FOR GRAND PRIZE: Trip is subject to availability and other restrictions. Winner and guest must be able to travel during the 08/09 winter season. If winner is unavailable at such time, prize will be forfeited in its entirety without compensation of any kind. If winner is not accompanied by a guest on trip, prize elements will only be awarded in amounts appropriate for actual number of travelers; and, in such event, winner will NOT receive any compensation relative thereto. Winner and guest must travel together on same itinerary as determined by Sponsor in its sole discretion. If guest is a minor, they must travel with his/her parent/legal guardian on trip (i.e., the Grand Prize winner).
Approximately 2,500 official entry forms will be made available in-store at Seattle, Washington REI store. Odds of winning a prize depend on the total number of eligible entries received (both on-line and in-store).
4. GENERAL CONDITIONS: All taxes on prizes and all expenses not specified herein associated with claiming/use/acceptance prize is the sole responsibility of the winner. Grand Prize winners must sign and return an affidavit of eligibility, a liability release, and, where lawful, a publicity release within 10 days of the date on documents. Guest of Grand Prize winner (if minor, his/her parent or legal guardian) must sign and return a liability release and where lawful a publicity release prior to the issuance of travel documents. Grand Prize winner and guest may also be required to sign additional documentation from the Montana Department of Commerce and/or the host mountain and/or to provide the Montana Department of Commerce and/or the host mountain with written authorization from a licensed physician as a pre-condition to taking trip. In the event of noncompliance with these requirements (as applicable), or if prize notification is returned as undeliverable, such prize will be forfeited and an alternate winner selected from all remaining eligible entries received for drawing. By participating, entrant releases and agrees to hold harmless The Montana Department of Commerce and their respective parent, affiliates, prize suppliers, advertising and promotion agency and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, losses or damages of any kind to persons and/or property arising from acceptance, possession, use/misuse of any prize or participation in this Sweepstakes. By accepting prize, where legal, winner grants to Sponsor the right to use the winner's name, picture, voice, likeness and biographical information for advertising/promotional/trade purposes, and any and all rights to such use, without additional consideration.
5. LIMITATIONS OF LIABILITY: Sponsor is not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW. Any use of robotic, automatic, macro, programmed or like on-line entry methods will void all such entries by such methods, and result in disqualification of any entrant using such methods. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site. If, for any reason, the on-line component of the Sweepstakes is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of the on-line component of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, modify or suspend the on-line component of the Sweepstakes and select the winners in a drawing from all eligible event and mail-in entries received and all eligible on-line entries received prior to and/or after (as appropriate) the action taken by Sponsor. In such event, notice will be posted at www.skimt.com.
6. WINNERS LIST: For names of winners, mail a self-addressed, stamped envelope to Travel Montana, Attn: Montana Winter Vacation Sweepstakes Winners List, 301 S. Park Ave., Helena, MT 59620 by January 31, 2009.
